Assisted reproductive technology is the use of medical procedures to achieve a pregnancy. Such procedures are frequently used for couples with fertility issues or LGBTQ families.

Assisted reproduction can involve an elaborate legal maze for intended parents, surrogates, carriers, donors, or recipients. Our team is especially understanding of the complex feelings and challenges that hopeful parents experience when trying to build their families.

Marks Gray represents and assists all parties involved in the family building process. The practice handles surrogacy or gestational carrier agreements, egg, sperm and embryo donation agreements, second parent adoptions, and finalization of parental right proceedings.

Florida law recognizes third-party reproduction and family building through surrogacy, pre-planned adoption, and the use of donor gametes. The Marks Gray Surrogacy and Assisted Reproductive Technology team assists clients with all legal aspects of third-party reproduction, including:

  • Drafting and reviewing traditional and/or gestational surrogacy agreements on behalf of intended parents or surrogates
  • Preparing and obtaining orders establishing parentage
  • Drafting and reviewing egg, sperm, or embryo donation agreements
  • Any other legal needs for the protection of the child and parents

Litigator and Family Law Attorney Courtney Johnson leads the practice. Johnson is a member of the American Bar Association’s Family Law Section, Assisted Reproductive Technologies Committee, as well as the Jacksonville Bar Association’s Adoption Law Committee.

Johnson understands the issues facing parents using assisted reproduction in their journeys to parenthood. After years of struggling with infertility, Johnson and her husband used an amazing gestational surrogate who carried and gave birth to their son. She is passionate about sharing her personal story and experience along the way, and prides herself on being deeply committed and responsive to her clients.
