Immigration Success Story: H-1B for Skilled Workers and Professionals

The Marks Gray Immigration Team is already helping clients with H-1B petitions for the upcoming April lottery. This month, we are highlighting the success story of a French citizen who received a cap-subject (lottery subject) H-1B petition last year under the FY2017 lottery.

After receiving notice from us that his H-1B petition was selected under the lottery, our client said, “For real!…Oh my god!!!! Thank you very much!!!!”

This candidate was here as an intern in J-1 status for our client a design-build firm.  Our client wanted to keep him on the team, and they retained us to strategize, prepare and file a successful H-1B petition subject to the lottery.

The H-1B allows U.S. employers to employ foreign workers in specialty occupations. However, demand far exceeds supply; last year, there were 236,000 petitions for the 85,000 H-1B visas available.

Also, for certain H-1B visa professions, proof of a license is required. In this case, the candidate, an engineer, was an intern in training and did not have an engineering license.  We used a provision of the law that allows us to file his H-1B as license-exempt, working under the supervision of a licensed professional.

We prepared a strong and timely H-1B petition highlighting the candidate’s degrees, specialized knowledge, and experience, and our candidate was fortunate enough to be randomly selected in the April lottery.

The approval of his H-1B was possible because of our documentation, up-to-date knowledge of USCIS’ requirements, advanced preparation… and a little bit of luck!

As a result, our client is currently working as a civil engineering associate in Jacksonville and our employer client is continuing to benefit from his contributions.  The Marks Gray Immigration Team is proud to be a part of their journey.
