FY 2021 H-1B Cap Petitions Update
Giselle Carson Apr 5, 2020 in H-1B/H-4
USCIS announced that it received about 275,000 H-1B registrations and roughly 46% of them were for prospective beneficiaries with U.S. advanced degrees (master’s or higher). Electronically registered H-1B cap petitions selected under the registration for FY 2021 can now be finalized and filed.
Petitioners and beneficiaries must follow existing statutory and regulatory requirements to establish H-1B eligibility at the time the petition is filed and through adjudication.
The period of filing indicated on the registration selection notice is expected to be 90 days (or up until June 30, 2020). All of the selected registrations must be filed by this date.
It’s also expected that some selected registrations might not convert to H-1B cap petitions. If this occurs, there might be a second selection, but there is no concrete information about this at this time.
