Shareholder Tyler J. Oldenburg’s Verdict for the City of Lake City Affirmed

by | Jan 16, 2019 | Announcement

The First District Court of Appeal by its Order dated October 31, 2018, affirmed, Per Curiam, the defense verdict in favor of Marks Gray’s client, the City of Lake City.

The appeal was from a verdict, dated September 23, 2017, arising from a case in which the plaintiff, America’s CNG, LLC, sued the City of Lake City claiming the City was in breach of contract. As a result of the alleged breach, the Plaintiff claimed it had incurred over $12,500,000.00 in damages. Mr. Oldenburg defended the case on the grounds that there was not a valid contract (due to the omission of a signed non-compete provision), the Plaintiff failed to perform (or was not able to perform) its obligations under the contract, and that the Plaintiff did not sustain any damages as a result of the City’s conduct. At the conclusion of a nine-day jury trial in Lake City, Florida, the jury returned a defense verdict.

“We’re pleased and honored that the court once again affirmed the jury’s decision in this case,” said Marks Gray’s president, Frederick H. Kent, III. “It is a testament to the skill and experience that Mr. Oldenburg, and our firm, provides to each client.”
