Marks Gray Shareholder L. Johnson "Johnny" Sarber Receives A Winning Verdict
Marks Gray, P.A. is pleased to announce the firm obtained a complete defense verdict for its client, Dixie County, at the conclusion of a jury trial on August 20, 2014. Shareholder L. Johnson “Johnny” Sarber successfully defended his client at trial.
The plaintiff alleged that she injured her ankle and knee and aggravated her prior back condition when she fell at a garbage roll-off site while throwing trash into a dumpster, and that the county was negligent in its maintenance of the property. Plaintiff argued specifically that the county improperly left a gap between the raised roll-off ramp and the dumpster, that unmaintained weeds obscured the gap, and that her left leg became lodged in the gap causing her injuries. Marks Gray attorney Johnny Sarber defended the case on the grounds that the roll-off site and dumpster were in a reasonably safe condition and that the plaintiff’s fall and injury were not caused by any problem with the property. At the conclusion of a three day jury trial in Cross City, Florida, the jury returned a verdict determining that Dixie County was not negligent.
